PLEAS

Guilty – A judicial confession that one is guilty as charged. It is an admission of guilt.

 Nolo Contendere (No Contest) – A statement that the defendant does not wish to contest the pending charges.  Nolo contendere (no contest) is not an admission or denial of guilt.

 

Not Guilty - A denial of guilty to the pending charges

 


 

COURT COSTS AND FINES

 

Court costs are assessed if you are found guilty at trial, request a Driving Safety Course, or if you plead guilty or nolo contendere (no contest).  Court costs vary by charge.

 


 

PAYMENT OPTIONS

 

The court accepts cash, checks, money orders and credit cards.  Checks and money orders should be made payable to City of West University Place.

 


 

CONTINUANCES

 

Requests for a continuance must be made in person, or by an attorney, at least one (1) day before the appearance date.  You must fill out and sign a reset form at the clerk’s office before a continuance will be granted.  Only one reset will be granted.

JUVENILES

 

The Municipal Court has jurisdiction over juveniles (under age 17) charged with most Class C misdemeanors, including traffic offenses.

 

All juveniles are required to appear in court with a parent or guardian.

 


 

EXPIRED VIOLATIONS

 

Certain violations may be dismissed at the court's discretion and upon payment of a $20.00 compliance fee.  Please contact the clerk's office for futher information.

 


 

DRIVING SAFETY COURSE

 

You may be eligible to request a driving safety course and have your citation dismissed.  The request must be made in writing on or before the court date.

 

To qualify you must meet the following:

·        Have a valid Texas driver’s license and proof of financial responsibility (liability insurance)

·        Pay court cost and administrative fee

o       Speeding and most other moving violations $107.00

o       Speeding in School Zone $132.00

·        Plead guilty or nolo contendere (no contest)

·        Have not taken a driving safety course for a traffic violation within the 12 months preceding the current offense

·        Are not currently taking a driving safety course for another traffic violation

 

You are not eligible, if:

·        You hold a commercial driver’s license;

·        You committed one of the following offenses:

o       Passing a School Bus

o       Speeding 25 mph over posted speed limit

o       Leaving the scene of an accident

o       Reckless driving

o       Duty to give information and render aid

Serious traffic violaitons

o       An offense in a construction zone where workers are present

 

You will be allowed 90 days to complete the course and must, on or before the 90th day, present your completion certificate to the court. The deadline for taking a Driving Safety Course will not be extended and failure to comply will result in a $200.00 fine.

JURISDICTION

The West University Place Municipal Court has jurisdiction over Class C Misdemeanors and City Ordinance Violations punishable by fine only.
